Definitions

Service: Pinkk's analytics and link tracking platform.
User: Any individual or organization accessing or using the Service.
Account: A registered profile with login credentials used to access the Service.

Account Creation & Security

You are responsible for maintaining the confidentiality of your account credentials.

Link Tracking & Analytics Use

Users retain ownership of their links and analytics data.
Pinkk collects, processes, and displays analytics for the sole purpose of providing Service functionality.
Users agree not to use analytics or tracking in violation of applicable laws.

Payments & Billing

Access to premium features requires subscription payment.
Users authorize Pinkk to charge the selected payment method.
Refunds are handled according to our Refund Policy.
Users are responsible for all applicable taxes.

Intellectual Property

Pinkk owns all intellectual property in the Service itself, including platform code, branding, and UI.
Users retain ownership of content they create or upload.
Users grant Pinkk a limited, non-exclusive license to process their data to provide the Service.

Limitation of Liability

The Service is provided "as-is" and "as available."
Pinkk does not guarantee accuracy, reliability, or uptime of analytics.
Pinkk is not liable for damages arising from user campaigns, lost revenue, or data use.

Termination / Suspension

Pinkk may suspend or terminate accounts for violations of these Terms or the Acceptable Use Policy.
Users may terminate their account at any time by following the account deletion process.
Upon termination, access to analytics and links may be revoked.

Governing Law & Dispute Resolution

These Terms are governed by the laws of South Africa.
Disputes arising from these Terms will first attempt to be resolved through good faith negotiation.
If unresolved, disputes will be submitted to binding arbitration in South Africa.

Changes to Terms

Pinkk may update these Terms at any time.
Users will be notified of significant changes via email or platform notifications.
Continued use of the Service constitutes acceptance of the updated Terms.
